These Terms of Service ("Terms") govern your use of NovoScuba websites, online platforms, training services, digital resources and related services.

NovoScuba is operated byNovoScuba Limited, 7 Bell Yard, London, WC2A 2JR, United Kingdom.

By accessing or using a NovoScuba service, creating an account or purchasing a product or service from us, you agree to these Terms. If you do not agree to them, please do not use our services.

1. NovoScuba Services

NovoScuba provides scuba training, educational content, certification services, professional membership services and digital tools for divers, professionals and Dive Stores.

Some NovoScuba services may be provided through independently owned Dive Stores or authorized NovoScuba Professionals.

Additional terms may apply to particular courses, memberships, certifications, purchases or professional programs. Where additional terms apply, they will be made available as part of the relevant service or transaction.

2. Accounts

Some NovoScuba services require an account.

You are responsible for providing accurate information and keeping your account information up to date.

You are also responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account. You should notify NovoScuba promptly if you believe your account has been accessed without permission.

Accounts may not be transferred, shared or used to impersonate another person unless NovoScuba expressly permits this.

3. Training and Certification

Completion of online learning or knowledge-development materials alone does not necessarily constitute completion of a NovoScuba certification.

Certifications may require additional practical training, assessments, dives, prerequisites, medical requirements or other conditions specified in the relevant NovoScuba training standards.

Certifications are issued only when the required standards have been satisfactorily completed and confirmed by an appropriately authorized NovoScuba Professional.

NovoScuba may correct, suspend or withdraw a certification or professional rating where it was issued in error, obtained fraudulently, or where action is required under applicable NovoScuba standards, quality-assurance procedures or law.

4. Dive Stores and NovoScuba Professionals

NovoScuba Dive Stores and Professionals may be independently owned or operated businesses and are not necessarily employees, agents or representatives of NovoScuba Limited.

They are responsible for delivering in-person training and services in accordance with NovoScuba standards and applicable local laws.

Prices charged by independent Dive Stores or Professionals for training, equipment, travel, diving activities or other services may differ from fees charged directly by NovoScuba.

5. Purchases and Payments

Where NovoScuba sells a product or service directly, the applicable price will be displayed before purchase.

Prices, products and services may change from time to time. A change will not normally affect a purchase that has already been completed, except where required by law or agreed with you.

If a product or service is displayed with an obvious pricing or description error, we may correct the error and, where appropriate, cancel or refund an affected transaction.

Additional cancellation or refund terms may apply to particular purchases and will be provided where relevant.

6. Acceptable Use

You agree not to use NovoScuba services in a way that is unlawful, fraudulent, harmful or disruptive.

You must not:

• Attempt to gain unauthorized access to accounts or systems
• Interfere with the security or operation of NovoScuba services
• Introduce malware, malicious code or other harmful material
• Misrepresent your identity, qualifications or certifications
• Copy or redistribute protected NovoScuba content except where expressly permitted
• Use NovoScuba services to infringe the rights of another person or organization
• Use automated systems to extract data or content without permission

7. Intellectual Property

NovoScuba websites, course materials, training standards, text, graphics, logos, software, video, audio, design elements and other content are owned by NovoScuba Limited, its licensors or other authorized rights holders.

They are protected by applicable copyright, trademark and other intellectual-property laws.

NovoScuba grants you a limited, personal, non-exclusive, non-transferable and revocable right to access content made available to you for its intended purpose.

Unless expressly permitted, content may not be copied, republished, sold, distributed, modified or used commercially without prior written permission.

8. Feedback and Suggestions

We welcome feedback about NovoScuba.

If you voluntarily provide suggestions, ideas or feedback, you grant NovoScuba permission to use that feedback to develop and improve our products and services without an obligation to compensate you.

This does not transfer ownership of photographs, documents or other material that you submit for purposes unrelated to feedback.

9. Community Content

Where NovoScuba services allow you to post, upload or share content, you remain responsible for that content and must have the right to share it.

Community participation is also subject to ourCommunity Guidelines

We may remove content or restrict access where reasonably necessary to enforce these Terms, our Community Guidelines, applicable standards or law.

10. Third-Party Services and Links

NovoScuba services may contain links to, or integrate with, services operated by third parties.

Third-party services are governed by their own terms and policies. NovoScuba is not responsible for the availability, content or practices of services that we do not operate.

11. Changes to NovoScuba Services

NovoScuba continually develops its services and may add, modify, replace or discontinue features where reasonably necessary.

We do not guarantee that every feature will remain available indefinitely.

Where a material change significantly affects a paid service, we will take reasonable steps to provide appropriate notice where practicable.

12. Suspension and Termination

You may stop using NovoScuba services at any time.

NovoScuba may restrict, suspend or terminate access where reasonably necessary, including where:

• These Terms have been materially breached
• There is suspected fraud or misuse
• Security of an account or service is at risk
• Payment obligations remain outstanding
• Action is required under NovoScuba professional or quality-assurance standards
• We are required to do so by law

Where appropriate and reasonably practicable, we will provide notice before taking such action.

13. Availability and Accuracy

We work to keep NovoScuba services accurate, secure and available, but we cannot guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable because of maintenance, updates, technical issues or circumstances outside our reasonable control.

Information published through NovoScuba services may be updated or corrected when necessary.

14. Diving Risks

Scuba diving and related activities involve inherent risks.

NovoScuba educational materials are intended to support properly supervised training and are not a substitute for required practical instruction, appropriate medical advice, good judgment or compliance with recognized diving practices and local requirements.

Divers are responsible for diving within the limits of their training, experience, health, environmental conditions and applicable regulations.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.

To the extent permitted by law, NovoScuba Limited will not be liable for indirect or consequential loss arising from the use or inability to use NovoScuba digital services.

NovoScuba is not responsible for losses caused by circumstances outside its reasonable control or by services independently provided by third parties, Dive Stores or Professionals, except where applicable law provides otherwise.

16. Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising directly from your unlawful use of NovoScuba services, your material breach of these Terms or your infringement of another person's rights.

17. Copyright Concerns

If you believe material available through a NovoScuba service infringes your copyright or other intellectual-property rights, please contact us with sufficient information to identify the material and explain your concern.

19. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer rights that apply in the country where you live.

If a dispute arises, we encourage you to contact us first so that we can try to resolve the matter informally.

Nothing in these Terms removes any right you may have to bring a claim before a court or other competent authority under applicable law.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

21. No Waiver

If either party does not immediately enforce a right under these Terms, that does not mean the right has been waived.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices or legal requirements.

The current version will always be published on this page with its effective date.

Where a material change significantly affects your rights or use of a service, we will provide appropriate notice where required.

23. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms that apply to a particular service or purchase, form the agreement between you and NovoScuba regarding your use of those services.
